Martin Tolhurst Solicitors launches fixed price Franchise Advice service

The Corporate department at Martin Tolhurst Solicitors is pleased to introduce a new fixed price service for new and existing business that are entering into (or have previously entered into) a franchise agreement.
We appreciate when starting a new business or operating an existing one, there are significant costs involved and prudent business owners are seeking best value in the services they employ.
Franchise agreements are usually prepared by the Franchisor and as a result, they are not primarily drafted with the best interests of the Franchisee in mind. It is important to ensure you receive some advice on the agreement so you understand it before you sign it. There are substantial obligations within a franchise agreement and future disputes with the Franchisor can be minimised or avoided if you are aware of, and understand these restrictions and obligations before you sign the agreement. You can then concentrate on running your business to give it the best chance of success.
We recognise that franchise agreements are often lengthy and complex documents so legal costs to obtain advice can be significant. This can lead to potential franchisees proceeding without any advice, which can lead to problems later if something significant is missed.
Martin Tolhurst Solicitors has now introduced a new service where existing and potential franchisees can obtain a written report on what we consider to be 11 of the most important provisions that are generally included in most franchise agreements. This will extend to 12 provisions if the franchise involves business premises. This limited report, which is bespoke to the franchise agreement you are considering, will help you to decide whether or not to proceed with the agreement or whether you wish to seek further advice before proceeding further.
We understand the need to be able to budget and avoid surprise costs so this service will be provided on a fixed fee basis with no additional costs beyond the figure we quote to you when you contact us. If you decide you need more advice and assistance then we can also assist with that and can separately agree costs with you.
The purpose of the limited report we are offering is to ensure any prospective franchisee can afford to obtain some advice before committing to long term legal obligations with a franchisor.
Time is also a key factor when starting a new business so we are committing to provide the written report to you within 5 working days after receiving a copy of the franchise agreement and your formal instruction papers (signed terms of business, ID and payment on account). As such, you can be sure to avoid long delays receiving this important advice.
